It brings up an interesting question, though. Venues that have cover bands, karaoke, jukeboxes, etc., pay their ASCAP/BMI fees and that covers all the entertainment that comes through the place, right? Well, what about the bands? As long as you're playing in liscensed bars, fine, but what if you get booked for a private party? Or street fair or arts festival? Could/should a band get liscensed to cover songs, just a a "cover my ass" type of thing?

Not-for-profit shows are not targeted.

In general, intellectual property infringement suits are only useful against entities who make a profit from the use of the property. Punitive damages are rare and you can't get blood out of a rock.

Not so anymore with non-profit community festivals. I posted this in the law section recently concerning ASCAP fees for events. One event I am involved with received a threatening letter to the effect if a license fee was not paid.
